Intellectual Property Rights

Intellectual property protection allows developers of new plant varieties and improved seeds to recoup their investment, while also allowing for the development of new varieties and improvements for the benefit of growers and consumers. Plant varieties may be protected by various forms of intellectual property, including, but not limited to patents, plant variety protection (PVP), agreements, trademarks, copyrights and trade secrets.

The genetics and traits of soybean varieties may be protected by one or more US patents.

  • A US patent holder can prevent others from making, using, offering for sale, and selling, or importing the claimed invention in the United States.
  • Breeding and certain research activities are prohibited.
  • Infringing activities may include, but are not limited to, saving harvested crop and replanting selling, marketing, offering for sale, importing, exporting, producing and reproducing the protected variety.

Plant Variety Protection (PVP) to a soybean variety

The genetics of many soybean varieties may  also be protected by US Plant Variety Protection.

  • The protected variety may be used for certain plant breeding activities.
  • Unauthorized reproduction of the protected variety is strictly prohibited.
  • Infringing activities include, but are not limited to, selling, marketing, offering for sale, importing, exporting, producing and reproducing the protected variety.
